Disclosures of your personal data

  • We may share your data with other third parties in their capacity as data controllers (i.e. legal, tax, real estate, immigration advisors and consultants) or various other service providers such as banks and providers of additional goods or services as and when required. Additionally, where you personal data is used by our employees, agents, contractors or other third parties, we limit such access to those with a business need to know and ensure they are subject to a duty of confidentiality. Lastly, in the event of any suspected personal data breach, we have implemented rigorous procedures to deal with such cases and will notify you as well as any applicable regulators where legally required to do so.

Data retention

How long will you retain my personal data?

We shall retain your personal data only for as long as reasonably necessary to fulfil the purpose for which it was collected. This may include for the purposes of meeting any legal, tax, accounting, regulatory or reporting requirements. In any case, we will not retain your personal data for any period exceeding 10 years from the date of completion/termination of services to you.

In determining the retention period appropriate for your personal data, the factors we consider include the nature and sensitivity of the data, the amount, potential risk of harm in the event of unauthorised use or disclosure, whether the purpose for which the data was collected has been fulfilled and whether those purposes can be fulfilled through other means.

For tax purposes, we are required by law to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers.

In some circumstances, we may anonymise your personal data (so that it can no longer identify you individually) for statistical or research purposes. In such cases, we may continue to use this information indefinitely and without further notice.

Your legal rights

You have a number of rights under data protection laws in relation to your personal data.

  • Right to Request Access – You can check that we are lawfully processing your data as well and receive a copy of all the data we hold about you.
  • Right to Request Correction – You may have any incomplete or inaccurate data we hold about you corrected. However, we may require you to verify the accuracy of the amended information.
  • Right to Erasure – In certain circumstances, this allows you to request the deletion or erasure of your personal data if there is no good reason for us to continue retaining it. Such circumstances include:
    • if you have successfully exercised your right to object (see below).
    • If we have processed your information unlawfully.
    • If we are required to erase your personal data in compliance with laws and regulations.

Please note that in certain situations we may not be able to comply with a request for erasure for specific legal reasons. In such instances, we will notify you of the reasons at the time of the request.

  • Right to Object – You may object to us processing your personal data where we are relying on the legal basis of a legitimate interest to do so (or those of a third party). However, in some cases we may demonstrate sufficiently compelling grounds to process your information which may overrule the right to object.
  • Right to Request Transfer – You also have the right to request the transferring of your personal data to you or a third party. In this case, we will provide to you, or the specified third party, your personal data in an electronic commonly used machine-readable format. Please note that this right only applies to personal data collected through automated means which you provided consent for us to use, or where the personal data was used to perform a contract with you.
  • Right to Restriction of Processing – This would enable you to ask us to suspend processing of your data in the following scenarios:
    • For the purposes of you asking us to establish the accuracy of the data;
    • If our processing and use of your data is unlawful, but you do not want to exercise your right of erasure;
    • If you need us to continue retaining the data longer than we require it, for example if the information is necessary for you to establish or defend legal claims; or
    • If you have exercised your right to object, but we need to verify whether we have an overriding legitimate grounds to continue its use.
  • Right to Withdraw Consent – Where we are relying on your active consent to process your personal data as the legal basis, you may withdraw such consent at any time. However, please note that doing so will not render unlawful any processing of your data carried out before consent was withdrawn. Additionally, such withdrawal of consent may mean we are unable to provide certain services or products to you, in which case we will advise you as such at the time of the withdrawal.
  • You also have the absolute right to object any time to the processing of your personal data for direct marketing purposes.

No fee usually required to access personal data

To access your personal data (or exercise any of your other rights) you do not usually have to pay a fee. However, a reasonable fee may be imposed if your request is clearly unfounded, repetitive or excessive. Alternatively, we may decide to refuse compliance with your request in such circumstances.

We may require specific information from you in order to comply with your request. We may need to verify your identity and ensure your right to access the personal data (or exercise any of your other rights.

To ensure the swiftest response, we may also need to contact you to ask you for further information in certain circumstances.

How long will it take us to respond

We will aim to respond to all legitimate requests within one month. However, it may occasionally take us longer where your request is particularly complex or numerous. In any case, we will keep you updated.
